Terms of Service
Please read these Terms of Service ("Terms") carefully before using TrackHQ, operated by Speeir Limited ("we", "our", "us").
1. Acceptance of Terms
By accessing or using TrackHQ (the "Service"), you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
TrackHQ connects fitness agencies, trainers, and clients in one platform: trainers build workout plans on the web and assign them to clients or groups, and clients log their sessions in the mobile app.
3. Accounts
When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your password and for all activities that occur under your account.
You must immediately notify us of any unauthorised use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Speeir Limited. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Speeir Limited.
5. User Content
You retain ownership of any content you submit to the Service (e.g., workout plans, client data). By submitting content, you grant Speeir Limited a non-exclusive, worldwide, royalty-free licence to use, store, and display your content solely for the purpose of operating the Service.
6. Data Isolation
Each agency operates in a fully isolated environment. Speeir Limited uses technical and organisational measures to ensure that data from one agency is never accessible to another agency. However, you remain responsible for the accuracy and legality of the data you upload.
7. Prohibited Uses
You may not use the Service:
- In any way that violates any applicable national or international law or regulation
- To transmit unsolicited commercial communications
- To impersonate or attempt to impersonate Speeir Limited, an employee, or another user
- To attempt to gain unauthorised access to any other agency's data
- In any way that could damage, disable, or impair the Service
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may export your data before termination by contacting support.
9. Limitation of Liability
In no event shall Speeir Limited, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of your use of or inability to use the Service.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice before new terms take effect. Your continued use of the Service after changes constitute your acceptance of the new Terms.
